PithyAI Terms of Service (DRAFT)

Draft, revision 2 (2026-10-30), after the first legal review. Items marked [Counsel: …] are legal decisions still open. Do not publish until every bracket is resolved. When these terms are published, set `TERMS_VERSION` in `packages/shared/src/account.ts` to the version date below; the server records it with each new account.

These terms are an agreement between you and [Counsel: the operator, as named in the Privacy Policy] ("we") about your use of the PithyAI app and service.

1. Accepting these terms. You accept these terms when you sign in for the first time and confirm that you agree. We record the date and the version you accepted. If you do not agree, do not use PithyAI.

2. The service. PithyAI records, transcribes and summarizes meetings, and lets you ask questions about them. AI output can be wrong or incomplete. Check important details against the recording or transcript before you rely on them. PithyAI is not legal, medical, financial or other professional advice.

3. Your account. You need an Apple, Google or email account to use PithyAI. Keep access to it secure. You are responsible for activity under your account. You must be at least [Counsel: the minimum age, matching the Privacy Policy] to use PithyAI.

4. Recording other people. You must tell everyone in a meeting that you are recording and get their agreement where the law requires it. Do not use PithyAI to record anyone secretly or unlawfully. You are responsible for the recordings you make and import, including any sensitive information in them.

5. Your content. You keep all rights to your recordings, transcripts and summaries. You permit us to store and process them only to provide the service to you, using the providers listed in the Privacy Policy. We do not use your content to train AI models.

6. Plans and payments.

• Free: the free plan includes a limited number and length of meetings each month, as shown in the app.
• Pro: Pro is an auto-renewing subscription, monthly or yearly, billed by Apple or Google to your store account. The price and period are shown in the app before you buy. It renews automatically at the same price and period until you cancel. Cancel before your next renewal date in your App Store or Google Play subscription settings; the Pro screen in the app links there. After cancelling, Pro stays on until the end of the period you paid for. Deleting your PithyAI account does not cancel the subscription.
• Refunds: refunds are handled by Apple or Google under their policies, without limiting any refund rights you have by law.
• Fair use: Pro includes up to 20 hours of meetings a month and a daily number of questions, as shown in the app.
• Price and plan changes: we tell you before a price increase or a reduction in a plan's limits takes effect. Apple and Google ask for your consent to a price increase where their rules require it, and you can cancel before it applies.

7. Acceptable use. Do not:

• misuse the service or use it for unlawful purposes;
• try to access other users' data;
• overload, disrupt or reverse-engineer the service;
• resell it.

We may suspend or close an account that breaks these rules. We will tell you why unless the law or the safety of others prevents it.

8. Deletion and closing accounts. You can delete meetings and your account at any time. The Privacy Policy explains what happens to your data. We may close a free account that has not been used for [24] months, after telling you by email at least 30 days before. We may end the service as a whole with at least [30] days' notice. Before it ends, you can export your data, and paid Pro time that has not been used is refunded [Counsel: confirm the mechanism, as refunds go through the stores].

9. Availability. We work to keep PithyAI running but do not promise it is always available or error-free. Recordings stay on your phone until uploaded, so keep the app installed until a meeting shows as processed.

10. Liability. [Counsel: rewrite for the governing law. A starting point:]

• Rights we cannot limit: nothing in these terms limits liability that cannot be limited by law (for example for fraud, or for death or personal injury caused by negligence), or your mandatory rights as a consumer.
• Indirect losses: to the extent the law allows, we are not liable for indirect or consequential loss, or for loss of profits, business or data you could have avoided by checking AI output or keeping your own copies.
• Cap: to the extent the law allows, our total liability is limited to the greater of (a) what you paid us in the 12 months before the claim and (b) [USD 100].

11. Your consumer rights. If you use PithyAI as a consumer, you keep all the rights that the consumer law of the country where you live gives you and that cannot be waived. These terms do not take them away.

12. Governing law and disputes. [Counsel: governing law, for example the laws of the Emirate of Dubai and the federal laws of the UAE; the courts or forum; and how this applies to consumers who live elsewhere.]

13. Changes to these terms. We may change these terms for legal, security or product reasons. We publish every version with its date.

• Material changes: we tell you in the app at least [30] days before they apply, and ask you to accept them. If you do not accept, you can delete your account, and your Pro subscription can be cancelled in your store settings with any refund the stores or the law provide.
• Other changes (corrections, clarifications) apply when they are published.
